TheWKOUT Limited, a company registered in England & Wales with company registration number 12518625, and (“we”, “us”, or “our”) have created this Privacy Policy to explain how we collect, use, disclose and otherwise process personal information in connection with operating our business. This Privacy Policy describes the practices concerning the information collected by TheWKOUT Limited through the use of TheWKOUT Limited’s websites, services and applications with which this Privacy Policy is provided, including without limitation, through TheWKOUT TV and TheWKOUT Services.
This Privacy Policy applies to TheWKOUT Limited’s websites and applications and other online services or applications with which this Privacy Policy is provided, and TheWKOUT Limited’s collection of information from corresponding social media features, applications, websites, and pages (each a “The WKOUT Service” and collectively, the “The WKOUT Services”). In addition to describing how TheWKOUT Limited collects, uses, discloses and otherwise processes personal information, this Privacy Policy explains the rights and choices available to individuals with respect to their personal information.
Through, for example, TheWKOUT TV or TheWKOUT Services, TheWKOUT Limited may provide additional privacy notices to a user (i.e., you) at the time that data is collected. This type of an “in-time” notice will govern how TheWKOUT Limited may process the user-provided information at that time.

1. Information Collected
TheWKOUT Limited may obtain information about a user in a variety of ways, including through a user’s access and use of TheWKOUT TV and TheWKOUT Services, when a user calls, emails or otherwise communicates with TheWKOUT Limited (including through social media), or when a user participates in a drawing, sweepstakes, contest, event or other promotion.
The information that TheWKOUT Limited collects, whether from a user directly or automatically, may be considered “personal information” in certain jurisdictions or “personal data” under the European General Data Protection Regulation (the “GDPR”). Whenever TheWKOUT Limited refers to “personal information” in this Privacy Policy, it means personal information or personal data as defined by applicable laws or regulations in the relevant jurisdiction.

TheWKOUT Limited may only collect some of the information above for certain of its products or services including, without limitation, TheWKOUT TV and The WKOUT Services. For example, if a user only uses a particular application, TheWKOUT Limited may not collect the user’s email.
In addition to the above, TheWKOUT Limited may also collect the following types of information:
To customize TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, to user requirements, TheWKOUT Limited may ask a user to provide the user’s fitness goals and other related information. Separately, TheWKOUT Limited may offer the user opportunities to add further information, such as the user’s weight, which will provide additional customization of TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, for the user, such as the ability to use Apple Health, Samsung Health or track activity. If a user chooses to refrain from sharing some or all of this information with TheWKOUT Limited, the user may not have access to certain features of TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV, TheWKOUT Services, or other related applications; and
Content, comments, photographs, video submissions or a user’s likeness when the user provides it to TheWKOUT Limited as part of community and social features.
2. Sources of Information and Purposes of Use
Some of the information is user-provided to TheWKOUT Limited, and some of the information is collected by TheWKOUT Limited when the user accesses and uses TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, or other related applications. TheWKOUT Limited also may obtain information about a user (including personal information) from its business partners, such as vendors, and others.
Information collected from a user
Email address. TheWKOUT Limited may use a user’s email address to (i) communicate with the user about TheWKOUT Limited, TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, and provide the user with exclusive offers; ii) respond to user requests, inquiries, comments, and suggestions; and (iii) communicate with the user about the user’s account.
The following are examples of the types of information that TheWKOUT Limited -- through TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, -- may collect directly from a user:
Name. TheWKOUT Limited requires a user’s name at the time of registration in order to process payments;
Username and/or Password. Certain of TheWKOUT Services use this information to facilitate user access to TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, or other related applications and to validate user login for security purposes;
Payment card and other payment information. If a user pays for TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, or a related application or service directly through TheWKOUT Limited, the user authorizes TheWKOUT Limited to have its payment processor collect this information;
Fitness Goals. A user may choose to provide TheWKOUT Limited with information about the user’s goals so that TheWKOUT TV or TheWKOUT Services can be personalized;
Gender. TheWKOUT Limited may ask a user’s gender to help personalize TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, allow the user to track calories and to help TheWKOUT Limited understand customer demographics. This information is provided voluntarily;
Age. A user may choose to provide the user’s age to help personalize TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, allow the user to track calories and to help TheWKOUT Limited understand customer demographics. This information is voluntarily provided;
Weight and/or target weight. A user may choose to provide the user’s weight in order to track calories;
User Content (e.g., comments, photos, or videos). A user may choose to provide user content when using community or social features; and
Customer Service Interactions. If a user contacts the customer support team for TheWKOUT Limited, the information provided by the user during that interaction will be collected.
Information collected by automated means (“Automated Information”)
TheWKOUT Limited collects Automated Information through the use of cookies, and other technologies. Please see the Cookie Policy for more information on cookies. In addition to cookies, such other technologies may include:
"Pixel tags" (i.e., "clear GIFs" or "web beacons") that are tiny images (typically just one-pixel) that can be placed on a Web page or in electronic communications to a user in order to help TheWKOUT Limited measure the effectiveness of content by, for example, counting the number of individuals who visit TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, online or verifying whether a user has opened one of the emails sent by TheWKOUT Limited or seen one of the webpages connected to TheWKOUT Limited.
"HTML5" (i.e., the language in which some websites, such as mobile websites are coded) may be used to store information on a user’s computer or other device about usage activities and to help determine how TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, are being used by visitors, how TheWKOUT TV or TheWKOUT Services can be improved and to customized.
Web browsers may offer users of TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, the ability to disable receiving certain types of cookies; however, if cookies are disabled, some features or functionality of TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, may not function correctly. TheWKOUT Limited or third-party service provider(s) thereof may assign a unique user identifier through automated means in order to match information collected from a user through different means or at different times, including both personal information and Automated Information, and to use such information as described in this Privacy Policy.

to collect insights about user access to and use of TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, and any related applications to improve TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, and features, including development of new products and features;

For example, TheWKOUT Limited may capture when a user visits a screen, taps a button, permits notifications, upgrades, or otherwise interacts with TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services; and
to monitor and analyze the effectiveness of communications (including by identifying when emails sent to a user have been received and read).
Information collected from service partners and integrated services
TheWKOUT Limited may obtain information, including personal information from third parties and sources integrated with or into TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, to aid in providing such products or services or to facilitate user access to TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, for example, as described below.
If a user purchases a subscription to an application related to TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, neither Google nor Apple provide TheWKOUT Limited with any personal information of the subscription purchaser (like name, email or payment information). Only an anonymized Subscription ID or Order ID gets transferred to TheWKOUT Limited. If a user creates an account with or for TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, this anonymized subscription information gets attached to the user’s record for the purpose of subscription sharing with the user’s account across multiple devices.
A user may be given the option to access or subscribe to TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, through the use of a third-party social media account, such as Facebook or Google. If the user selects this option, the social media provider may make certain of the user’s personal information available to TheWKOUT Limited, such as the user’s email address or other unique identifier or TheWKOUT Limited may be asked to share certain information with such social media provider. If the user chooses to register or access through the user’s social media provider, the user authorizes TheWKOUT Limited to collect the user’s information from such provider and process it in accordance with this Privacy Policy. The user also authorizes TheWKOUT Limited to share the user’s information with the social media provider as necessary to permit the user access TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, using the user’s social media account. TheWKOUT Limited recommends that every user review the user’s social media provider’s privacy policies carefully before using its service to connect to TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services.
3. How TheWKOUT Limited May Use Your Personal Information

linking user account across one or more devices or TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, so that a user can enjoy a consistent experience across all devices and/or TheWKOUT Limited’s products or services that the user accesses;
maintaining or servicing accounts, providing customer service, operation of TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, and any related mobile applications; processing or fulfilling orders and transactions, verifying user information, processing payments;

understanding and evaluating how services and features of TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, perform with users;
ascertaining insights about usage in order to improve TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, and provide customers with enhanced features as well as inform development of new features and products/services; and
developing customized or personalized experiences of TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, such as remembering user information so a user does not have to re-enter it each time the user accesses or uses such products or services.
Debugging/Repair
identifying and/or repairing of impairments to existing functionality of TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services.
Marketing
understanding customers in order to more effectively market TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services; and
emailing -- with customer consent when required -- information about products and services and exclusive offers.
Quality, Integrity, and Safety Maintenance and Verification
improving quality of TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, including upgrade or enhancement of such products or services;
verifying and maintaining the quality, integrity and safety of TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services;
tracking and responding to quality, integrity and safety matters;
protecting rights and property of TheWKOUT Limited;

TheWKOUT Limited may also aggregate and/or de-identify any collected information, such that the information no longer identifies any specific individual. TheWKOUT Limited may use, disclose and otherwise process such information for its own legitimate business purposes – including historical and statistical analysis and business planning – without restriction.
4. How TheWKOUT Limited May Share Information about Users with Others
TheWKOUT Limited may share information about users for the purposes described in this Privacy Policy or pursuant to a specific “in-time” privacy notice that TheWKOUT Limited may provide at the time information is collected.
Corporate Affiliates
TheWKOUT Limited may share a user’s information with other corporate affiliates for legitimate business purposes, including:
Assisting TheWKOUT Limited in technical processing operations, such as data hosting and maintenance, finance, legal, human resources and accounting assistance, securing data and systems and fighting against spam, abuse, fraud, infringement and other wrongdoings; and
Effecting corporate audit, analysis and consolidated reporting as well as compliance with applicable laws and regulations.
Third Party Service Providers
TheWKOUT Limited may share information about a user with the following categories of third-party providers for a variety of business purposes:
Customer Communications and Insights Platforms
TheWKOUT Limited may share email, application usage and interactions with third party customer communications platform providers for the following business purposes: performing services that allow TheWKOUT Limited to communicate with the user and administer the user’s account as well as track the user’s usage for internal analytics.
Internal Business Insights Platforms
The third-party internal business analytics platform used by TheWKOUT Limited provides TheWKOUT Limited with tools to help in understanding application usage and interactions and uncover insights that allow for product and feature improvements as well as marketing optimization. TheWKOUT Limited may share or make available unique user identifiers, IDFA, deviceID, IP address, Adjust ID and application usage and events (e.g., when a user subscribed to TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services) with these providers for the following business purposes: performing services that allow TheWKOUT Limited to (i) monitor and understand usage in order to enhance existing Services or develop new products and features and (ii) better understand customers in order to market TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, or related products, services and applications more effectively.
Customer Support
When a user contacts TheWKOUT Limited through one of TheWKOUT Limited’s support email addresses set forth in Contact Us section at the bottom of this Privacy Policy, the user’s email address may be directed through the third-party customer support platform used by TheWKOUT Limited, thus, allowing that platform to have access to the user’s email address, the content of the user’s email as well as date and time that the user’s request came into the TheWKOUT Limited’s system. TheWKOUT Limited uses these providers to allow TheWKOUT Limited to communicate with the user about the user’s account and to receive reports from users about the quality or safety of TheWKOUT TV, TheWKOUT Services or any related services or products.
Measurement and Attribution
These service providers offer tools that allow TheWKOUT Limited to measure and attribute the source of new subscriptions and that allow TheWKOUT Limited to uncover insights about usage and application events. TheWKOUT Limited may use unique user identifiers made available to TheWKOUT Limited from these third-party providers to help TheWKOUT Limited measure the effectiveness of advertisements (e.g., time and location of user acquisition) and to uncover information about how customers are using applications in order to improve their quality and safety. TheWKOUT Limited may share and/or store the unique identifiers with these providers for the same purposes.
Other technology providers necessary to provide TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, and other related products or services (including cloud storage and web hosting providers).
TheWKOUT Limited stores user-provided and Automated Information and/or aggregate or non-personally identifiable information with cloud storage providers. TheWKOUT Limited also may make certain Automated Information available for various purposes such as monitoring network traffic to detect malicious actors and to protect against malware, fraud or other unlawful uses or activity.
Payment processors
If a user subscribes to or purchases TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, outside of the Apple or Google stores, TheWKOUT Limited will process the user’s payment through a third-party provider. When a user pays in this manner, the user authorizes and directs TheWKOUT Limited to process payment through the payment processor.
Marketing providers
To assist with product marketing, TheWKOUT Limited, or third-party service providers used by TheWKOUT Limited, may use information collected from the user in connection with TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, or other product/service to provide advertisements and offers for other products/services. For example, if a user subscribes to or purchases a workout application from TheWKOUT Limited, TheWKOUT Limited may provide information to a marketing service provider (i.e., a unique online identifier) that enables them to present the user an advertisement for a meditation application. TheWKOUT Limited may share certain information with Facebook or other advertising partners that provide optimization services for advertising. A user can learn more about how to opt out of having such activity sent to Facebook at https://www.facebook.com/help/... and https://www.facebook.com/off_facebook_activity/. TheWKOUT Limited may use Google Ads to advertise TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services. When a user views or clicks on an advertisement on a website or application, tracking technology may be set by Google to help better provide advertisements that may be of interest to the user. A user may opt-out of the use of this tracking technology by visiting Google’s Advertising and Privacy page: www.google.com/privacy_ads.html. Additionally, TheWKOUT Limited may share information with Facebook, Instagram or SnapChat that allows creation of tailored or Lookalike Audiences. A user may learn more about Facebook Lookalike Audiences at https://www.facebook.com/busin... and Snapchat Audiences at https://support.snapchat.com/en-US/a/advertising-preferences. TheWKOUT Limited may obtain information in connection with a contest, sweepstakes, event, offering or other promotional activity that is jointly offered by TheWKOUT Limited and any third parties. By entering such contest or sweepstakes, a user authorizes and directs TheWKOUT Limited to share the user’s information with the third-party co-sponsor. TheWKOUT Limited may also share a user’s information with a third-party service provider who administers the promotion, event, offering, promotional activity, contest and/or sweepstakes. TheWKOUT Limited may also share aggregate information with third-party providers and platforms that help in understanding user demographic, including user demographic interests, habits and usage patterns for TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, to assist in effective product marketing.
Corporate Transactions
In connection with a corporate change or dissolution, including for example a merger, acquisition, reorganization, consolidation, bankruptcy, liquidation, sale of assets or wind-up of a business (each a “Corporate Transaction”), TheWKOUT Limited may share information about a user. Unless prohibited by applicable law or regulation, TheWKOUT Limited reserves the right to transfer the information that TheWKOUT Limited maintains in the event that TheWKOUT Limited engages in any Corporate Transaction (e.g., selling or transferring all or a portion of the business or assets). If TheWKOUT Limited engages in such a sale or transfer, if permitted, TheWKOUT Limited will direct the recipient to use the information in a manner that is consistent with this Privacy Policy. After such a sale or transfer, a user may contact the recipient with any inquiries concerning the processing of the user’s personal information.
Legal, Regulatory, Compliance, Etc.
TheWKOUT Limited may disclose and/or share user information to comply with legal or regulatory requirements – such as to comply with a court order, judicial subpoena or other subpoena or warrant -- industry standards, judicial process, and company policies, as well as to protect against, identify, investigate, prevent and respond to fraud, illegal activity -- like identifying and responding to incidents of hacking or misuse of TheWKOUT TV or TheWKOUT Services or other TheWKOUT Limited websites and related applications, adverse event reporting, and claims and other liabilities.
TheWKOUT Limited reserves the right to disclose user information when TheWKOUT Limited in good faith believes that such disclosure is appropriate or necessary to take precautions against liability, to protect the rights or property of TheWKOUT Limited or the legal and property rights of others and to investigate and defend third-party claims or allegations against TheWKOUT Limited or its officers, directors, owners or assigns.
TheWKOUT Limited may collect, use and disclose a user’s personal information as required or permitted by applicable law or regulation, or as directed by the user, in accordance with this Privacy Policy.
5.“Do-Not-Track” Disclosures
Some web browsers may transmit "do-not-track" (DNT) signals to the websites with which the user communicates. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted or whether a user is even aware of them. Because there is no industry standard concerning what, if anything, websites should do when such signals are received, TheWKOUT Limited does not currently process or respond to DNT settings in a user’s web browser. If and when a final standard is established and accepted, TheWKOUT Limited will reassess how to respond to DNT signals.

TheWKOUT Limited maintains a presence on several social networking and blogging platforms, such as Facebook, Instagram, Google, LinkedIn, Twitter, Snap, TikTok and Pinterest. TheWKOUT Limited may incorporate some third-party social networking features into TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, (including, allowing users to interact with others and share certain content and information on social media platforms) or utilize third-party provided platforms to publish or manage TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, or portions thereof. Through these platforms and features, TheWKOUT Limited may receive or may share information about a user, and this Privacy Policy applies to that information as well. In addition, some providers of third-party social media or blogging platforms utilized by TheWKOUT Limited have their own privacy policies that explain how those third parties may collect, use and protect user information (e.g., if a user establishes an account with such platform providers directly). By using social features, as a user, you agree to those third parties’ privacy policies and terms of use. If you choose to communicate with TheWKOUT Limited or another user through social features available on TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, or related applications or through related social media pages, or other similar communication or messaging features or services, such information may be made publicly available. For security purposes, please do not include any password, social security number or other government-issued identification number, payment card or other sensitive information via these features. TheWKOUT Limited has the right, but not the obligation, to monitor messages and communications between and among users for security and training purposes. TheWKOUT Limited may, but is not obligated to, remove any content deemed (in the sole discretion of TheWKOUT Limited) to be inappropriate.
7. Information for Individuals in the European Economic Area (EEA)
User Choices and Rights
If a user lives in the European Economic Area (“EEA”), the company that is responsible for your information under this Privacy Policy (the “data controller”) is: TheWKOUT Limited.
As a resident of the EEA, a user may have some or all of the following rights in relation to how TheWKOUT Limited uses the user’s personal information:
Access: a user may request access to the user’s personal information and receive copies of it;
Correction: a user may have inaccurate/incomplete personal information corrected and updated;
Object to, or Limit or Restrict, Use of Data: a user may ask TheWKOUT Limited to stop using all or some of the user’s personal information or to limit use of such information by TheWKOUT Limited;

If TheWKOUT Limited changes or deletes a user’s personal information or if the user declines to actively share certain personal information with TheWKOUT Limited, TheWKOUT Limited may not be able to provide the user with TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, or some of the features and functionality thereof. Additionally, a user may contact TheWKOUT Limited to request that TheWKOUT Limited not disclose the user’s personal information to third parties (other than those that are acting as TheWKOUT Limited’s agents to perform tasks on TheWKOUT Limited’s behalf, such as data processors). However, TheWKOUT Limited may reject requests for certain reasons, including if the request is unlawful or if it may infringe or impinge on the rights and freedoms of another person. For example, TheWKOUT Limited may not be able to accommodate certain requests by a user seeking to have TheWKOUT Limited cease the processing of the user’s personal information where such requests would not allow TheWKOUT Limited to continue to provide TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services, or access to such products or services to the user.
For user protection, TheWKOUT Limited may require proof of identity and/or user verification before TheWKOUT Limited can respond to user requests.
Legal basis for processing data
In this section, TheWKOUT Limited identifies applicable legal bases for processing personal information.
In some cases, TheWKOUT Limited has a legitimate interest for processing personal information that is collected, such as to develop, administer and support TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services; to operate, evaluate and improve business; to facilitate and manage engagement programs; to promote research; to support recruitment activities; or to facilitate a Corporate Transaction (including, without limitation, a sale of assets or merger or acquisition).
In other cases, TheWKOUT Limited processes personal information to fulfill contracts with business partners, such as third parties that distribute products/services.
TheWKOUT Limited may also need to process personal information to establish, exercise or defend against fraud, illegal activity, and claims and other liabilities, including by enforcing the terms and conditions that govern TheWKOUT Limited’s products or services, including without limitation TheWKOUT TV or TheWKOUT Services.
The processing of certain information may be necessary to comply with TheWKOUT Limited’s legal obligations, and for reasons of public interest, such as with respect to adverse events and product safety reporting.
TheWKOUT Limited may also process personal information as specifically permitted by applicable legal requirements.
If TheWKOUT Limited chooses to rely on consent for the processing of a user’s personal information, TheWKOUT Limited will seek such consent at the time the TheWKOUT Limited collects or has collected the user’s personal information.
International Data Transfer
TheWKOUT Limited may transfer a user’s personal information to countries other than the country in which the data was originally collected for the purposes described in this Privacy Policy. For example, if a user is located outside of England, TheWKOUT Limited may transfer or have transferred the user’s personal information to the United States, where TheWKOUT Limited is headquartered. 8. Information for Residents of California -- California Consumer Privacy Rights
User Choices and Rights
If a user is a California resident, the California Consumer Privacy Act (“CCPA”) may provide the user with notice and other rights regarding TheWKOUT Limited’s use of the user’s personal information in addition to those set forth elsewhere in this Privacy Policy. The CCPA Notice applies to “Consumers” as defined by the law. This section describes a user’s CCPA rights as a California Consumer and explains how to exercise those rights.
Access to Information and Data Portability Rights
A user has the right to send TheWKOUT Limited a request, no more than twice in a twelve-month period, for any of the following for the period that is twelve months prior to the request date:
• the categories of personal information that TheWKOUT Limited has collected about the user;
• the categories of sources from which TheWKOUT Limited collected the user’s personal information;
• the business or commercial purposes for collecting or selling the user’s personal information;
• the categories of third parties with whom TheWKOUT Limited has shared the user’s personal information;
• the specific pieces of personal information that TheWKOUT Limited has collected about the user;
• a list of the categories of personal information disclosed for a business purpose in the prior 12 months, or that no disclosure occurred; or
• a list of the categories of personal information about the user sold in the prior 12 months, or that no sale occurred. If TheWKOUT Limited indeed sold the user’s personal information, TheWKOUT Limited will explain:
the categories of personal information that TheWKOUT Limited sold; and
the categories of third parties to which TheWKOUT Limited sold personal information, by categories of personal information sold to each third party.
A user has the right to make or obtain a transportable copy, no more than twice in a twelve-month period, of the user’s personal information that TheWKOUT Limited collected in the period that is 12 months prior to the request date and is maintaining.
Data Deletion Rights
• Except to the extent that TheWKOUT Limited has a basis for retention under the CCPA, a user may request that TheWKOUT Limited delete the user’s personal information that TheWKOUT Limited collected directly from the user and is maintaining. TheWKOUT Limited is not required to delete personal information that TheWKOUT Limited did not collect directly from the user.
Exercising Your Rights
To make a request for access, portability or deletion according to user rights under CCPA, a user may make a request by clicking here, mailing a request to TheWKOUT Limited, DCC, London Road, Derby DE248UX or may exercise these rights via an authorized agent who meets the agency requirements of the CCPA. TheWKOUT Limited cannot respond to a user’s request or provide the user with personal information if TheWKOUT Limited is unable to verify the user’s identity or authority to make the request and confirm that the personal information relates to the requesting user. Any request a user submits to TheWKOUT Limited is subject to an identification and residency verification process (“Verifiable Consumer Request”).
The Verifiable Consumer Request must:
• Provide sufficient information that allows TheWKOUT Limited to reasonably verify the requesting user is the person about whom TheWKOUT Limited collected and stored personal information or an authorized representative thereof; and
• Describe the request with sufficient detail that allows TheWKOUT Limited to properly understand, evaluate, and respond to it.
Some personal information maintained about a user is not sufficiently associated with enough personal information about the user for TheWKOUT Limited to be able to verify that it is a particular user’s personal information (e.g., clickstream data tied only to a pseudonymous browser ID). As required by the CCPA, TheWKOUT Limited does not include that personal information in response to Verifiable Consumer Requests. If TheWKOUT Limited is unable to comply with a Verifiable Consumer Request, TheWKOUT Limited will explain the reasons for TheWKOUT Limited’s inability to do so in its response.
TheWKOUT Limited will make commercially reasonable efforts to identify personal information about a user that TheWKOUT Limited collects, processes, stores, discloses, and otherwise uses and to respond to the user’s Verifiable Consumer Request. TheWKOUT Limited will typically not charge a fee to fully respond to a user’s Verifiable Consumer Request, but TheWKOUT Limited may charge a reasonable fee, or refuse to act upon a request, if a user’s Verifiable Consumer Request is excessive, repetitive, unfounded, or unduly burdensome.
TheWKOUT Limited does not knowingly “sell”—as that term is defined by the CCPA -- personal information that collected from users and will treat personal information collected from a user as subject to a “do not sell” request.
TheWKOUT Limited will not discriminate against a user in a manner prohibited by the CCPA because the user exercise’s the user’s rights under the CCPA. However, TheWKOUT Limited may charge a different price or rate, or offer a different level or quality of good or service, to the extent that doing so is reasonably related to the value of the applicable data. In addition, TheWKOUT Limited may offer financial incentives for the collection, sale, retention and use of personal information as permitted by the CCPA that can, without limitation, result in reasonably different prices, rates, or quality levels. The material aspects of any financial incentive will be explained and described in a program’s terms and conditions. TheWKOUT Limited may add or change incentive programs and/or a program’s terms and conditions by posting notice on the program descriptions and terms and conditions linked thereto. Thus, a user should check terms and conditions regularly.
California's "Shine the Light" law, Civil Code section 1798.83, requires certain businesses to respond to requests from California customers asking about the businesses' practices related to disclosing personal information to third parties for the third parties' direct marketing purposes. TheWKOUT Limited does not currently engage in the type of sharing covered by that law. TheWKOUT Limited does not make any representations concerning third parties that do not collect personal information directly through TheWKOUT Services or any other service of TheWKOUT Limited.

9. Online Privacy Rights and Choices
Access, Edit and Delete User Information
For users that are residents of the EEA, user rights to access, edit and delete user information can be found in Section 7 of this Privacy Policy, “Information for Individuals in the European Economic Area”.
For users that are residents of California, user rights to access, edit and delete can be found in the Section 8 of this Privacy Policy, “Information for Residents of California”.
For users that are neither residents of the EEA or California, a user – depending on the user’s residence -- may be able to make requests to access, correct and/or delete certain personal information that the user provides to TheWKOUT Limited.
For a requesting user’s protection, TheWKOUT Limited may require proof and verification of identity and jurisdiction of residency before TheWKOUT Limited can answer such requests.
If a user wishes to make such a request, the user may contact TheWKOUT Limited at the applicable support email indicated in the “Contact Us” section of this Privacy Policy.
If TheWKOUT Limited changes or deletes a user’s personal information or if the user declines to actively share certain personal information with TheWKOUT Limited, TheWKOUT Limited may not be able to provide the user with access to TheWKOUT TV, TheWKOUT Services, other of TheWKOUT Limited’s services or some of the features and functionality thereof.
Once TheWKOUT Limited has verified that the requesting user owns the account, TheWKOUT Limited will honor such requests at TheWKOUT Limited’s sole discretion and in accordance with applicable law.
Device Permissions
Mobile platforms have permission systems for specific types of device data and notifications, such as camera and microphone as well as push notifications. Where applicable, a user can change the user’s settings on the user’s device to either consent or oppose the collection of the corresponding information or the display of the corresponding notifications. Doing so, however, may result in a loss of full functionality
Uninstall
A user can stop all information collection by any of a TheWKOUT Limited application by deactivating the user’s account in accordance with instructions provided by TheWKOUT Limited and then uninstalling the application using the standard uninstall process for your device.
If a user uninstalls a TheWKOUT Limited application from the user’s device, the unique identifier associated with the user’s device will continue to be stored.
If a user reinstalls a previously uninstalled TheWKOUT Limited application on the same device from which the application was previously uninstalled, TheWKOUT Limited will be able to re-associate this identifier to the user’s previous transactions and activities.
If a user receives commercial email from TheWKOUT Limited, the user may unsubscribe at any time by following the instructions contained within the email.
A user may also opt-out from receiving commercial email from TheWKOUT Limited or from receiving any other promotional communications that TheWKOUT Limited may send to the user from time to time, by sending a request to TheWKOUT Limited by the applicable support email indicated in the Contact Us section of this Privacy Policy.
Please be aware that if a user requests to opt-out of receiving commercial email from TheWKOUT Limited or otherwise modifies the nature or frequency of promotional communications that the user receives from TheWKOUT Limited, such request may take up to ten business days to be processed, and, as such, the user may nonetheless receive promotional communications from TheWKOUT Limited during that period.
After a user requests to opt-out from receiving commercial messages from TheWKOUT Limited, a user will continue to receive transactional or administrative messages from TheWKOUT Limited regarding TheWKOUT TV, TheWKOUT Services or any other TheWKOUT Limited services.
Location Information
If a user chooses to opt-in, some of TheWKOUT Limited’s applications may collect the precise real-time location of the user’s device. In such cases, the user may be able to opt out from further allowing TheWKOUT Limited to have access to such location data by managing location preferences in TheWKOUT Limited’s application and/or on the user’s device.
Nevada Users
Under Nevada law, Nevada residents may opt out of the “sale” of certain “covered information” (as defined under Nevada law) collected by operators of websites or online services. TheWKOUT Limited currently does not engage in the “sale” of “covered information”, as those terms are defined by Nevada law. Moreover, TheWKOUT Limited does not have plans to sell such information. However, if a user that is a Nevada resident would like to be notified should TheWKOUT Limited decide to sell personal information covered by such law, please contact TheWKOUT Limited and make a request to be so notified. A user is responsible for updating any change in email address by the same method. TheWKOUT Limited is not obligated to cross-reference other emails that a user may have otherwise provided to TheWKOUT Limited for other purposes. TheWKOUT Limited will log such requests and contact the requesting user if TheWKOUT Limited’s practices change.
Marketing Opt-Outs
Some of the service providers that used by TheWKOUT Limited for marketing and displaying advertisements on other websites and mobile applications may participate in the Digital Advertising Alliance’s (“DAA”) Self-Regulatory Program for Online Behavioral Advertising.

If a user chooses to use TheWKOUT Limited services from outside the United Kingdom, with laws governing data collection and use that may differ from the laws of the United Kingdom, the user is transferring the user’s personal information outside of those regions to the United Kingdom for storage and processing.
TheWKOUT Limited may transfer your data from the United Kingdomto other countries in connection with the storage and processing of data to operate TheWKOUT Limited’s business.
By using TheWKOUT Limited services, including without limitation TheWKOUT TV and TheWKOUT Services, and providing personal information, a user consents to such transfer, storage and processing.

10. Data Retention
Except as provided below, TheWKOUT Limited may retain a user’s personal information for whichever occurs last of (1) three (3) years after TheWKOUT Limited discovers that the user ceased using TheWKOUT Limited services, including without limitation TheWKOUT TV and TheWKOUT Services; or (2) TheWKOUT Limited no longer believes that TheWKOUT Limited has a legitimate business need for the information or may need the information to fulfill any legal and regulatory obligations.
TheWKOUT Limited may retain other information that is not personally identifiable for backups, archiving, prevention of fraud and abuse, analytics, or where TheWKOUT Limited otherwise reasonably believes that TheWKOUT Limited has a legitimate reason to do so.
11. Protection of Personal Information
TheWKOUT Limited employs various measures intended to safeguard the security and integrity of personal information collected through TheWKOUT Limited services, including without limitation TheWKOUT TV and TheWKOUT Services. Despite such measures, however, TheWKOUT Limited cannot and do not guarantee that information will be absolutely safe from interception or intrusion during transmission or while stored on TheWKOUT Limited’s systems, or otherwise. As such, a user provides information to TheWKOUT Limited at the user’s own risk.
If a user corresponds with TheWKOUT Limited by email, text message or using Web forms like a "contact us" feature available through TheWKOUT Limited services, including without limitation TheWKOUT TV and TheWKOUT Services, the user should be aware that the user’s transmission might not be secure from access or interception by unauthorized parties.
TheWKOUT Limited has no liability for disclosure of a user’s information due to errors or unauthorized acts of third parties during or after transmission.
If a user creates an account as part of using TheWKOUT Limited services, including without limitation TheWKOUT TV and TheWKOUT Services, the user is responsible for maintaining the confidentiality of the user’s account password and for any activity that occurs under the user’s account.
A user must notify TheWKOUT Limited of any suspicious or unauthorized use of the user’s password or access to the user’s account.
If TheWKOUT Limited believes that the security of a user’s personal information in care of TheWKOUT Limited may have been compromised, TheWKOUT Limited may seek to notify the user. If TheWKOUT Limited has the user’s email address, TheWKOUT Limited may notify the user by emailing the user at the most recent email address the user has provided to TheWKOUT Limited via the user’s account profile. A user must keep the user’s email address in the user’s account profile up to date. A user can change that e-mail address in the user’s account profile at any time. If a user receives a notice from TheWKOUT Limited, the user can print the email to retain a copy. To receive these notices, a user must check the user’s-e-mail account using the user’s computer or mobile device and email application software. TheWKOUT Limited may also post a conspicuous notice on one of TheWKOUT Limited’s websites or notify the user through TheWKOUT Limited services, including without limitation TheWKOUT TV and TheWKOUT Services. The user consents to use of email, text message and/or notification through, for example, a TheWKOUT Limited application as a means of such notification. If a user prefers to have TheWKOUT Limited use the postal service to notify the user in this situation, the user must let TheWKOUT Limited know by submitting a request to TheWKOUT Limited. A user can make this election at any time. Such election will apply to notifications made by TheWKOUT Limited after a reasonable time thereafter for TheWKOUT Limited to process such election. A user may also request a print copy, at no charge, of any electronic notice that TheWKOUT Limited has sent to the user regarding a compromise of the user’s personal information.
12. Links to Websites and Third-Party Content
TheWKOUT Limited may provide links to websites and content that ate not owned or operated by TheWKOUT Limited. The websites and content to which TheWKOUT Limited links may have separate privacy notices or policies. TheWKOUT Limited is not responsible for the privacy practices of any entity that is not within TheWKOUT Limited ownership or control. TheWKOUT Limited encourages a user to review the privacy policies of such third parties before providing them with any personal information.

TheWKOUT Limited services, including without limitation TheWKOUT TV and TheWKOUT Services, are intended for general audiences over 18 years of age. TheWKOUT Limited does not knowingly collect information from children under the age of 18 years. No person under the age of 18 years should download, access or use TheWKOUT Limited services, including without limitation TheWKOUT TV and TheWKOUT Services. If any person or entity believes that TheWKOUT Limited may have personal information from or about a child under the age of 18 years, that person or entity should contact TheWKOUT Limited here (please include your name, mailing address, and email address). TheWKOUT Limited will attempt to delete the account of any child under the age of 18 that is reported to TheWKOUT Limited as soon as possible.
